Dental Intake Forms Pro

1. Agreement Overview

By subscribing to Dental Intake Forms Pro (“Service”), you agree to these Terms and Conditions. This is a flexible, non-binding subscription service with no long-term contracts or commitments.

2. Subscription Terms

2.1 No Binding Contracts

Our service operates on a month-to-month subscription basis. There are no binding long-term contracts, minimum commitment periods, or cancellation penalties. You are free to cancel your subscription at any time.

2.2 Billing and Payment

  • All subscriptions are billed monthly in advance
  • Payments are processed securely through Stripe, Inc.
  • Your subscription will automatically renew each month unless cancelled
  • We do not store credit card information on our servers
  • All payment processing and security is handled by Stripe's PCI-compliant infrastructure

2.3 Cancellation Policy

  • Cancel anytime by emailing support@intake.dental or following Stripe link from subscription initiation
  • No cancellation fees or penalties
  • Access continues until the end of your current billing period
  • No partial month refunds for mid-cycle cancellations, except for initial 30-day guarantee.

3. Service Description

Dental Intake Forms Pro provides digital patient intake form software for dental practices. The service includes form creation, patient data collection, and encrypted storage capabilities.

WE ARE NOT RESPONSIBLE FOR HIPAA COMPLIANCE BREACHES.

While our platform is built with advanced AES-256 encryption and secure interfaces, HIPAA compliance is a comprehensive requirement that extends beyond software. You acknowledge and agree that:

  • You are solely responsible for your practice's overall HIPAA compliance
  • You must secure your own website and hosting environment
  • You must use BAA-compliant email services for PHI transmission
  • You must properly train all staff on PHI handling procedures
  • You must implement appropriate physical and administrative safeguards
  • You must maintain your own Business Associate Agreements (BAAs) with relevant third parties

We provide the tools; you are responsible for their proper implementation and use in accordance with HIPAA requirements.

4. Security and Encryption

Our platform features:

  • AES-256-GCM encryption for all patient data
  • Secure HTTPS transmission protocols
  • Encrypted database storage
  • Regular security updates and patches

However, security is a shared responsibility. You must maintain secure passwords, keep your WordPress installation updated, use SSL certificates, and follow security best practices.

5. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any HIPAA violations or compliance issues
  • We are not responsible for data breaches resulting from user negligence
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for one month of service

6. User Responsibilities

As a subscriber, you are responsible for:

  • Maintaining the security of your WordPress installation
  • Keeping all software and plugins updated
  • Training staff on proper PHI handling
  • Implementing appropriate access controls
  • Maintaining secure backups of your data
  • Ensuring HIPAA compliance in all aspects of your practice

7. Intellectual Property

The Service, including all software, design, and documentation, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

8. Modifications to Terms

We reserve the right to modify these terms at any time. Significant changes will be communicated via email to the address associated with your account. Continued use of the Service after changes constitutes acceptance of modified terms.

9. Termination

Either party may terminate this agreement at any time. We reserve the right to terminate service for violations of these terms or for abusive behavior.

10. Governing Law

These Terms are governed by the laws of the United States and the state in which our company is registered, without regard to conflict of law principles.
